
Dear actor,
- FIRSTLY, Understand the importance of a written contract.
- Insist on a written contract. (Private / Commercial)
- Do due diligence.
- Know your rights and the rights of others. You're not an island.
- Read and understand the contract. Engaging a lawyer is more advisable. A comma can change a statement in these documents.
- Negotiate, seek for clarification and propose alternative wordings where necessary.
- Document all communication esp via email. If audio recording, it's advisable to seek permission.
- Protect your copyright always.
- LASTLY, retain your copy of the FULLY (all parties) SIGNED CONTRACT. Not just a copy.
A CONTRACT MUST CONTAIN
- Date and place of the contract
- Clear description of all the parties signing the agreement.
- A termination clause.
- What rights are involved and affected in this agreement.
- Consideration - what, who, how and when payable.
- Insurance and security
- Royalties and licenses.
- Amendment Clause
- Law applicable and jurisdiction.
I'm sure there's much more to be added here, but this is what I learned back then, and has guided my negotiations to date.
HOWEVER, in as much as you understand these basics, IT'S ALWAYS ADVISABLE TO GET THE HELP OF A LAWYER.
